A Birmingham man now faces a formal capital murder charge in the fatal shooting of another man on the city’s west side.
Court records released Monday show that 26-year-old Austin Roosevelt Kimbrough is charged in the killing of 22-year-old Levi Wells.
West Precinct officers arrived to find Wells unresponsive inside a vehicle.
He was taken to UAB Hospital, where he died at 3:28 p.m. Friday.
Officer Truman Fitzgerald said a preliminary investigation showed Wells and Kimbrough became involved in a confrontation after Wells drove away from a nearby gas station in his vehicle.
Kimbrough allegedly shot Wells and then fled the scene.
The police department’s Crime Reduction Team later arrested Kimbrough. Investigators initially charged him with attempted murder and shooting into an occupied vehicle.
Authorities later upgraded the charges to capital murder. The charge is capital because the victim was inside a vehicle at the time of the killing.
